Resolutions


Special Licensing Authority Appointments
Town Council approved several appointments to the Parker Special Licensing Authority, including two regular members for terms through Dec. 31, 2023 (Mike Appleby and Bryan Campbell), three regular members for terms through Dec. 31, 2024 (Jon Brusco, Kelli Narde and Gregory Simpson), two alternate members (Ronald Kuhns and Ricky Milburn), a Chairperson (Narde) and a Vice Chairperson (Appleby).

Assistant Judge Appointment
Town Council approved the appointment of Courtenay Patterson as Assistant Judge for the Parker Municipal Court. Patterson will serve temporarily as the substitute Municipal Court Judge until a permanent presiding Municipal Court Judge is appointed. After that appointment is made, Patterson will serve in the case of temporary absence, sickness, disqualification or other inability of the Municipal Court Judge to act.

Agreements


Stroh Ranch/Hess Annexation Agreement Amendment (Northern Property) 
Town Council approved the sixth amendment to the Amended and Restated Stroh Ranch/Hess Annexation Agreement, which governs the terms under which the property commonly known as Anthology North Planned Development was annexed into the Town and how it is to be developed in the future. The sixth amendment addresses the following: 1. Allows the developer of Segment 1, marketed as Tanterra, flexibility in the types of financial security required for the construction of traffic signals within the project; 2. Allows the Tanterra Developer to secure its obligation for the future construction of Stroh Road with a letter of credit to the Town at Final Plat; and 3. Allows the developer of the SunMarke project to satisfy its obligation for a portion of the Oak Gulch Regional Trail by providing a cash-in-lieu payment to the Town instead of designing and constructing the Regional Trail. This also eliminates the SunMarke developer’s obligation to construct a pedestrian bridge that is no longer required for the design and future use of the Regional Trail.

Contracts
Town Council awarded five contracts over the amount of $500,000: 

1. A purchase agreement with Kaiser Premier in the amount of $609,488 for the purchase of a Jet/Vacuum Truck to perform ongoing maintenance of the Town’s stormwater infrastructure.

2. A design contract with Anderson Mason Dale Architects (AMD) for the Town Hall Expansion Project, for the contract terms and conditions only. The next step in the process is awarding the design contract and first amendment. The design contract is structured so the Town and AMD sign the contract for the terms and conditions of service, then services are added to the contract by means of four contract amendments. The first amendment is for preliminary (30%) design services, the second amendment is for design development (60%) and entitlement services, the third amendment is for construction documentation (100%) services, and the fourth amendment is for construction administration services. Each amendment will be presented to Town Council for award. The overall design contract for this project including all four amendments is anticipated to be between $2 million to $2.5 million depending on project scope. The contract duration spans a time of approximately 2.5 years. Construction is tentatively scheduled to begin in the first quarter of 2024 and completion is estimated for the first quarter of 2025.

3. The first amendment to the approved design contract with Anderson Mason Dale Architects for the Town Hall Expansion Project for preliminary design services in the amount of $289,100. The primary objectives of the preliminary design phase are to build upon the results of the Facility Master Plan, advance the design to 30% and build a project cost model.

4. A construction contract with JHL Constructors for the Town Hall Expansion Project, for the contract terms and conditions only. The pre-construction fee and guaranteed maximum price will be added to the contract by means of two contract amendments. The next step in the process is awarding the construction contract and first amendment. The construction contract is structured so the Town and JHL sign the contract for the terms and conditions of service, then services are added to the contract through a series of two contract amendments. The first amendment is for pre-construction services and the second amendment adds the guaranteed maximum price (GMP) into the contract, which officially starts construction. The pre-construction fee and GMP for this project is anticipated to be between $23 million and $26 million, depending on project scope. The contract duration spans a time of approximately 2.5 years. 

5. The first amendment to the approved construction contract with JHL Constructors for the Town Hall Expansion Project for pre-construction services in the amount of $49,500. The primary objectives of the pre-construction phase are to prepare cost estimates, construction schedules and a guaranteed maximum price (GMP) proposal.

Agritainment - Use Permitted by Right
The property owner of the parcel known as Flat Acres Farm is proposing to annex their land into the Town of Parker with a zoning designation of A-Agricultural. In response, the Town proposes to amend the Land Development Ordinance (LDO) to add an additional permitted use within the A-Agricultural Zone District. The proposed LDO amendment would revise Section 13.04.050 to add “Agritainment” as a permitted use and incorporate a definition of the use.

Public Meeting Notices
Town Council approved a resolution designating the Town of Parker website, ParkerOnline.org, as the posting location for all Town Council meeting notices, and the bulletin board at Town Hall as the location for the posting of physical notices in the case of known website outages or emergency meetings. Town Council is required by State law to designate a public place for the posting of meeting notices each year.

Drainage Easement - North Parker Road Operational Improvements Project
Town Council approved a resolution accepting the conveyance of a drainage easement for a portion of Lot 4A-2, Peakview Center, Third Amendment, to allow for the construction of storm drainage infrastructure proposed with the Town’s North Parker Road Operation Improvements Project.

Tract Q Property Annexation Hearing Date
Town Council approved a resolution setting a second reading date of Feb. 21, 2023 for Council to consider the annexation of the Town-owned Tract Q property. The Town proposes to annex 20.25 acres of Town-owned undeveloped land located at the southeast corner of the intersection of Chambers Road and Mainstreet. The property will be zoned Open Space (OS) to accommodate the future construction of a section of Newlin Gulch Trail through the property.

Contracts Over $100,000
Town Council awarded two contracts over the amount of $100,000: 

1. A purchase agreement with John Elway Chevrolet in the amount of $126,256 for the purchase of three replacement Police SUV’s as part of the 2023 fleet replacement plan. These pieces of equipment were identified and approved as candidates for replacement during the 2023 budget process.

2. A contract renewal with The Key People for 2023 custodial services at Town-operated facilities. The Town first entered into a multi-year renewable contract with The Key People in 2013 before establishing a new multi-year renewable contract in 2019.
